Welcome to Guardty. These Terms and Conditions (the "Terms") govern your access to and use of our online store and website (the "Services"), as well as all purchases made from us. Guardty is hosted on Shopify. Please read these Terms carefully.

1. Seller and scope

These Terms apply to all visitors, users and customers of the Services, in the version in force at the time of the order.

We may change these Terms for the future. The updated version is published on this website. Contracts already concluded remain subject to the version in force at the time of the order.

2. Use of the Services

By using our Services, you confirm that you are of legal age or that you are using them under the supervision of a parent or guardian. You agree not to use the Services for any unlawful or unauthorized purpose and not to do anything that could impair, interrupt or damage the operation of the Services. We reserve the right to refuse, limit or end access to the Services if these Terms are breached.

3. Products and availability

We do our best to show our products – RFID/NFC protection cards, travel accessories and digital guides – as accurately as possible, including their colors, descriptions and prices. Slight color differences may occur because of your device's screen settings. All products are available while stocks last. We may change or stop offering a product at any time; orders already accepted are not affected.

4. Prices and payment

All prices are shown in the currency displayed on the website and include applicable taxes where required. Shipping costs are shown separately before you place your order. The price shown at the time of the order applies. Payment is made when you place your order, using the payment methods shown at checkout. By providing your payment details, you confirm that you are authorized to use the chosen payment method.

5. Conclusion of the contract and language

The display of products on the website is not a binding offer. By clicking the order button, you submit a binding offer to purchase. After you place your order, you will receive a confirmation email in which we accept your order, and the contract is then concluded.

We may refuse an order before accepting it for legitimate reasons, in particular in case of suspected fraud or if the product is unavailable. In that case, we will refund any amount already paid without delay.

The language of the contract is English. We store the contract text and send it to you by email with your order confirmation.

6. Shipping and delivery

Processing and delivery times and shipping costs are set out in our Shipping Policy. Unless otherwise agreed, we deliver your order within 30 days of the conclusion of the contract. The risk of loss of or damage to the goods passes to you only when you take physical possession of the goods.

7. Right to cancel, returns and refunds

If you are a consumer in the United Kingdom or the European Union, you have the right to cancel your purchase within 14 days of receiving the goods, without giving any reason. We also offer a voluntary 30-day return policy from the day you receive your order, which does not affect your statutory rights. Details on returns, exchanges and refunds, as well as the model cancellation form, are set out in our Return and Refund Policy.

8. Faulty goods

If a product is faulty or does not match its description, you have the rights granted by the consumer laws of your country, such as repair, replacement, a price reduction or a refund, under the conditions set by law. To make a claim, contact us at contact@guardty.com.

9. Intellectual property

All content of the Services, including text, graphics, logos, images, product designs and software, is owned by Guardty or its licensors and is protected by applicable intellectual property laws. You may not copy, reproduce, distribute or use the content of the Services for commercial purposes without our prior written consent.

10. User-generated content

If you post content on the Services, such as reviews or comments, you grant us a non-exclusive, royalty-free right to use, reproduce and display that content as part of operating the Services. You are solely responsible for the content you post and you confirm that it does not infringe the rights of others and is not unlawful, offensive or inappropriate. We reserve the right to remove content that is unlawful or breaches these Terms.

11. Liability

We are fully liable in cases of intent and gross negligence, for injury to life, body or health, and in the cases provided for by product liability laws.

For slight negligence, we are liable only for breach of essential contractual obligations and only up to the typical, foreseeable damage for this type of contract. Nothing in these Terms excludes or limits our liability where such exclusion or limitation is not permitted by law, in particular regarding consumers' mandatory rights.

12. Links to third-party websites

The Services may contain links to third-party websites. Their operators are solely responsible for their content. You access these websites at your own risk.

13. Governing law and jurisdiction

These Terms are governed by the laws of the State of Wyoming, USA, excluding the United Nations Convention on Contracts for the International Sale of Goods.

If you are a consumer, this choice of law does not deprive you of the protection of the mandatory consumer protection laws of your country of residence, and you may bring proceedings in the courts of the place where you live.

We are not obliged and not willing to take part in dispute resolution proceedings before a consumer arbitration board.
